Terms & Conditions

Effective Date: August 1, 2026

Welcome to cowboystateplastics.com. This Website is owned and operated by Cowboy State Plastics, operating as American Rotomolding LLC (“Cowboy State Plastics,” “CSP,” “we,” “us,” or “our”). Cowboy State Plastics is a business-to-business rotational molding contract manufacturer. The Website provides information about our capabilities and services and allows visitors to contact us. The Website does not sell products to consumers and does not process online orders or payments.

Please read these terms and conditions (“Terms of Use”) carefully. By accessing or using the Website, you agree to be bound by these Terms of Use. If you do not agree to these Terms of Use, do not use this Website.

We may change these Terms of Use at any time and will post any revised version on the Website. Your continued use of the Website constitutes acceptance of the Terms of Use in effect at the time of use. We recommend that you review this page periodically.

1. Eligibility

The Website is intended for business use by individuals who are at least 18 years of age. By using the Website, you represent that you are at least 18 years old and that you have the authority to accept these Terms of Use on behalf of yourself or the business you represent. The Website is not directed at children, and children may not use it.

2. Use of the Website

You agree to use the Website only for lawful business purposes and in accordance with these Terms of Use. You are responsible for any information you submit through the Website and for ensuring that it is accurate and that you have the right to share it. We reserve the right to refuse service, restrict access, or remove content at our discretion.

3. Ownership of Materials and Limited License

All content on the Website, including text, information, files, data, graphics, logos, designs, photographs, images, illustrations, interfaces, software, and other works (collectively, the “Materials”), is owned or licensed by Cowboy State Plastics and is protected by applicable United States and international copyright, trademark, patent, and other intellectual property laws. The selection, arrangement, and compilation of the Materials is the exclusive property of Cowboy State Plastics.

We grant you a limited license to access the Website and view the Materials for your internal business evaluation purposes, subject to these Terms of Use. You may not modify, copy, download (except where a download is expressly offered, such as a design guide), distribute, transmit, display, reproduce, publish, license, create derivative works from, transfer, or sell the Materials for any public or commercial purpose without our prior written consent. All rights not expressly granted are reserved by Cowboy State Plastics and its licensors.

4. Trademarks

The trademarks, trade names, service marks, and logos displayed on the Website, including the Cowboy State Plastics name and logo (collectively, the “Marks”), are owned or licensed by Cowboy State Plastics. Product names, brand names, and marks of our customers or partners referenced on the Website are the property of their respective owners. Nothing on the Website grants you any right or license to use the Marks without our prior written consent.

5. Submissions and Inquiries

If you submit an inquiry, project description, drawings, files, comments, suggestions, or other materials through the Website (“Submissions”), you represent that you have the right to share them and that they do not violate any law or the rights of any third party. We will handle project files and technical information you send us as described in any separate agreement or nondisclosure agreement between us. In the absence of a separate agreement, you grant us the right to use Submissions as reasonably necessary to respond to your inquiry and evaluate a potential engagement.

General comments, feedback, and suggestions about the Website or our business that are not marked confidential and are not covered by a separate agreement may be used by us without restriction or compensation to you.

6. Confidential Project Information

We understand that customers often share sensitive product and technical information when discussing a potential manufacturing program. Confidential information exchanged in connection with a specific engagement is intended to be governed by a mutual nondisclosure agreement or the terms of a signed manufacturing or development agreement. Submitting information through the Website’s contact form, on its own, does not create such an agreement. Please contact us before sending information you consider confidential so that appropriate protections can be put in place.

7. Notice of Copyright Infringement

The Digital Millennium Copyright Act, 17 U.S.C. § 512 (“DMCA”), provides recourse to copyright owners who believe their rights have been infringed online. If you believe content on the Website infringes your copyright, you may send a notice to our designated contact that includes:

  • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
  • A description of the copyrighted work you claim has been infringed;
  • A description of where the allegedly infringing material is located on the Website;
  • Your contact information, including address, telephone number, and email address;
  • A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and
  • A statement, made under penalty of perjury, that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner.

Notices may be sent to: Cowboy State Plastics, 2199 Pyrite Road, Casper, WY 82604, Attn: Copyright Agent, or by email to info@cowboystateplastics.com. Only copyright infringement notices should be sent to this contact.

8. Privacy

We respect the privacy of visitors to the Website. Please review our Privacy Policy, which describes how we collect and use information. If you do not agree with our Privacy Policy, you should not use the Website or submit information through it.

9. Accuracy of Information

We try to keep the information on the Website accurate and current, including descriptions of our capabilities, materials, and processes. We do not guarantee that the content on the Website is accurate, complete, reliable, current, or error-free. Statements about capabilities, tolerances, materials, certifications, and processes are general in nature and do not constitute a commitment for any specific project. Program-specific commitments are made only in a signed quotation, purchase order, or agreement.

10. Disclaimer of Warranties

The Website is provided on an “as is” and “as available” basis. To the fullest extent permitted by applicable law, Cowboy State Plastics disclaims all warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement, with respect to the Website and the Materials.

Cowboy State Plastics makes no representations or warranties about the operation, security, or availability of the Website, or about the accuracy, reliability, completeness, or timeliness of the Materials. Cowboy State Plastics does not warrant that the Website or its servers are free of viruses or other harmful components and is not responsible for any damage to your device or data resulting from use of the Website. This disclaimer applies to the Website only and does not limit any warranty that may be provided in a separate signed agreement for manufacturing or development services.

Because some jurisdictions do not allow the exclusion of implied warranties, some of the above exclusions may not apply to you.

11. Limitation of Liability

To the fullest extent permitted by law, Cowboy State Plastics and its affiliates, and the officers, directors, employees, agents, and representatives of each, shall not be liable for any indirect, incidental, special, exemplary, punitive, or consequential damages arising out of or relating to your use of or inability to use the Website or the Materials, even if advised of the possibility of such damages. If you are dissatisfied with the Website or these Terms of Use, your sole remedy is to discontinue using the Website.

Because some jurisdictions do not allow the exclusion or limitation of liability for certain damages, some of the above limitations may not apply to you. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

12. Acceptable Use

You agree not to use the Website to:

  • Engage in or plan any unlawful activity;
  • Transmit false, misleading, defamatory, abusive, harassing, obscene, or otherwise objectionable material;
  • Infringe the intellectual property, privacy, or other rights of any third party;
  • Misrepresent your identity or the origin of any communication;
  • Interfere with or attempt to gain unauthorized access to the Website, its servers, or other accounts or networks;
  • Introduce viruses, malware, or other harmful code;
  • Reverse engineer, decompile, or disassemble any portion of the Website; or
  • Use any robot, scraper, spider, or automated means to access or copy content from the Website without our written permission.

13. Third-Party Links

The Website may contain links to third-party websites for your convenience. We do not control and are not responsible for the content, privacy practices, or availability of those websites. A link does not imply our endorsement of the linked website.

14. Security Monitoring

We reserve the right to monitor network traffic to the Website to identify and block unauthorized attempts to upload content, modify the Materials, or otherwise interfere with the Website. By using the Website, you consent to such monitoring.

15. Termination

These Terms of Use remain in effect while you use the Website. You may stop using the Website at any time. We may suspend or terminate your access to the Website at any time, without notice, if we determine that you have violated these Terms of Use. Provisions that by their nature should survive termination, including sections on ownership, disclaimers, limitation of liability, indemnification, and governing law, will survive.

16. Changes to the Website

We may modify, suspend, or discontinue all or part of the Website at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Website or the Materials.

17. Indemnification

You agree to indemnify, defend, and hold harmless Cowboy State Plastics and its affiliates, and the officers, directors, employees, agents, and representatives of each, from and against any claims, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to your use of the Website or the Materials, your violation of these Terms of Use, or your violation of any law or the rights of any third party.

18. Governing Law, Venue, and Jurisdiction

These Terms of Use are governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict-of-law rules. Venue and jurisdiction for any claim arising out of or relating to these Terms of Use or your use of the Website shall lie in the state or federal courts located in Casper, Wyoming, to which you consent. You agree that any claim or cause of action arising out of or relating to the Website, these Terms of Use, or the Privacy Policy must be filed within one (1) year after the claim or cause of action arose, or it will be permanently barred.

19. General Provisions

These Terms of Use, together with the Privacy Policy, constitute the entire agreement between you and us regarding your use of the Website and supersede any prior understandings on that subject. Section headings are for convenience only. If any provision is found to be invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full effect. Our failure to enforce any provision is not a waiver of our right to do so later. Nothing in these Terms of Use is intended to limit or replace the terms of any separate signed agreement between you and Cowboy State Plastics governing manufacturing, development, confidentiality, or other services.
